Court dismisses suit against FA

The stage is now clear for the Disciplinary Committee of the Ghana Football Association to re-hear the case involving the demotion of clubs, Mighty Jets and Great Mariners.

This was made possible after an Accra High Court on Thursday dismissed a lawsuit filed against the Ghana Football Association by division one side Mighty Jets.

Mighty Jets, demoted to the third tier of the Ghana league system for their role in playing a match of convenience with Great Mariners FC were in court challenging a GFA Appeals Committee decision to have its Disciplinary Committee re-hear a case involving the club in that particular game.

At Thursday’s sitting, Justice Asiedu stated that the court proceedings applied by the plaintiff was wrong explaining that a writ of summons was used instead of an application order for judicial review.

According to the judge, Mighty Jets, a member of the Ghana Football Association cannot run away from the disciplinary processes of the FA.

By the ruling, the Disciplinary Committee would re-hear the case involving Mighty Jets and Great Mariners. That match ended in 28-0 in favour of Great Mariners.

A cost of 3,000 GH cedis was awarded against the plaintiff, Mighty Jets.

Two weeks ago, an Accra High Court judge declined to hear the lawsuit filed brought against the FA by Mighty Jets. The Presiding Judge declined to sit on the case after conferring with the lawyers of both Mighty Jets and the Ghana Football Association.

The Appeals committee of the FA set aside the ruling of the Disciplinary committee banning some four clubs for their roles in playing a match of convenience and directed the disciplinary body to re hear the matter.
