Techiman City fined GH₵2000 for two counts of misconduct

Techiman City have been fined GH₵2000 after being charged with two counts of misconduct in respect to the GN Bank Division One League match between and Berekum Arsenals FC played on May 17, 2015.

On the first count, it was alleged that Techiman City FC had two persons (Berlin FC Chairman and Mr. Kwame) whose names were on the Team Sheet on the team’s bench and also the club’s supporters entered the inner perimeter without authorization which caused a hold up of play in violation of the Articles 23(5), 35(1)(a), 35(2) and 35(7)(d) of the GFA General Regulations and Article 66 of the GFA Disciplinary Code.

On the second count, Techiman City FC was charged for failing to control its officials when the club’s coach, Nana Adarkwah verbally attacked the match officials resulting in his expulsion from the inner perimeter, also the officials on the bench of the club obstructed the work of the medical attendants of the match and also attempted to assault the players and officials of Berekum Arsenals FC in violation of Articles 35(1)(a), 35(2) and 35(7)(d) of the GFA General Regulations and Article 66 of the Disciplinary Code in respect of this match.

DEFENCE Techiman Man City FC in its written Statement of Defence pleaded not guilty to the first charge but accepted part of the second charge. The club also waived its right to personal hearing.

PROCEEDINGS AND FINDINGS The Committee considered the depositions in the Charge Sheet, the written Statement of Defence and the reports of the match officials of the said match.

In his defence on the first count, Techiman City FC explains that: “We humbly deny that Techiman City FC invited the two officials to our official bench. Both Techiman City FC and Berlin FC use the same park, the Chairman of Berlin FC and his other officials are familiar with the grounds and those in charge there. Therefore in our response we wish to inform the Disciplinary Committee that the two individuals were not on our official bench and were not there with our prior notice or permission”

The Committee holds that it will side with the presumption under Article 85 of the Disciplinary Code on the facts stated in the match report as the club failed to disprove the facts of the match report. The Committee holds that the conduct of Techiman City FC is prohibited by the GFA Regulations.

In his defence on the second count, Techiman City FC explains that: “Techiman City FC accepts the charge against the club for the actions of its coach Nana Adarkwah. The coach has since shown remorse and has apologized for his actions and has been reprimanded by the club. However, we wish to deny that our officials obstruct the work of the medical team and also the claim that our official attempted to assault the players and officials of Berekum Arsenals. The Chairman of Arsenals had his car parked outside the stadium and was accompany of other people who he chatted with for minutes before moving”

The Committee holds that it will again side with the presumption under Article 85 of the Disciplinary Code on the facts stated in the match report as the club failed to disprove the facts of the match report. The Committee holds that the conduct of the supporters is outlawed by the GFA Regulations.

The Disciplinary Committee was satisfied with the evidence before it that the conduct of the supporters amounts to misconduct and a breach of Regulations of the GFA and shall accordingly apply the necessary sanction against Techiman City FC in this respect.

DECISIONS

The Disciplinary Committee makes the following decisions:

1. That the Committee having satisfied itself that the evidence adduced before it supports the charge of misconduct against the officials and supporters of Techiman City FC on both courts, hereby imposes a fine of Two Thousand Ghana Cedis (GH¢2,000.00) on Techiman City FC in accordance with Article 39(1)(b) of the GFA General Regulations.

2. That the fine mentioned in Decision 1 above, shall be paid to the GFA within fourteen (14) days upon receipt of this Ruling, failing which Techiman City FC shall automatically forfeit all subsequent matches after the said deadline in accordance with Article 15(b) of the GFA Disciplinary Code and Article 39(8)(b) of the First Amendment to the GFA General Regulations.

3. That Techiman City FC and its supporters are hereby warned to be of good behaviour and that should the club be found guilty of any misconduct charges during this football season, the Committee shall apply the maximum sanctions against the club.

4. That should any party be dissatisfied with or aggrieved by this Decision, the party has within three (3) days of being notified of this Ruling to appeal to the Appeals Committee (See Article 37(11) of the General Regulations of the GFA).
