A Tema High Court has dismissed an injunction which prevented the Ghana Football Association from determining the clubs relegated in 2008/2009 season and thereby deciding the start date of the new season.

The Court dismissed a suit filed against the sport body by plaintiff, Daniel Rockson, a supporter of Tema Youth Football Club that sought to overturn a decision by the Review Committee of the FA regarding the eligibility of Tema Youth's player, Emmanuel Clottey.

Presiding judge, Justice P.B Ofei, dismissed the application and awarded a cost of GH¢3,000 against the plaintiff.

Thursday's decision means the FA can go ahead to conclude deliberations at Congress which seeks to deal with Articles 8.8 and 8.9 on the relegation and determination of champions.

Congress deferred the amendments on the said Articles due to the pending court case.

Tema Youth were relegated from the elite competition after finishing in the bottom three following some point deductions that went against them in the final weeks to the end of the campaign due to the use of an unqualified player, Emmanuel Clottey.

The registration of the player was fraught with irregularities as the Disciplinary Committee ruled after Berekum Arsenals appealed against his use.

As a result, six points was taken off Tema Youth’s accumulated build up.
